Power of Attorney from UK to India


Power of Attorney from UK to India

I had sent a Power of Attorney document from UK to India recently and I wanted to share the procedure with all as it was very difficult to find the details online.

Power of Attorney (PoA)

It is a legal document giving a person the power to act for another person in general or financial matters.

There are many scenarios for which we need Power of Attorney but very common are,
  1. Get a loan from a bank in India.
  2. Buy or sell a property in India.
If it is to get a loan from a bank, the bank personnel would normally guide you to prepare the Power of Attorney but if it is for a property registration then you will not get proper information from the Sub-Registrar office.

Content

The first thing you have to decide the content you have to put in the Power of Attorney document. You can do one of the below to get the content,
  • If it is for a bank then mostly the bank will give you the content.
  • Contact a lawyer in India who will prepare the document for you.
  • Go to a vendor who sell stamp paper or people who prepares bond papers. They would normally have the content and they would give it for a small fee.
  • Select a template available online.

Stamp Paper vs Plain Paper

Both are acceptable but the stamp paper would be more formal than the plain paper. 

If you decide to go for stamp paper then ask someone to get a ₹50 or 100 stamp paper in your name and get the content typed and couriered to you.

Notary Public or High Commission?

Once you have the content ready in a document then you have to get it attested.

There are two ways you can get the attestation, from a Notary Public or from the Indian High Commission.

I think all Power of Attorney documents need to be registered in the Sub-Registrar office to become valid in India so check with the Sub-Registrar office where you have to register whether they would accept attestation from a Notary Public. 

First, I have got the attestation from a Notary Public along with an apostille certificate. But the Sub-Registrar office rejected the document and told that I should get it attested only from the Indian High Commission.

I have given procedure to get attestation from both then High Commission and a Notary Public and it is always better to confirm it with the Sub-Registrar office before you decide where to go.

I would say it would be better to get the attestation from the Indian High Commission than from a Notary Public as the probability of rejection is less.

Witnesses

PoA document should be witnessed by two people who are residing in the UK. They do not have to be UK citizens, people who are in work permit and in dependent visa can also sign.

Your spouse can sign as 1 witness, though it is legally acceptable, it is better to ask two friends to sign it for you. 

Attestation from Indian High Commission

Once you decide to go to the Indian High Commission for your attestation, you have to follow the following procedure,

Appointment: 
  • Gone are the days when you have to go early in the morning to get the token from the High Commission for your consular services. You can now book an appointment in the website Indian High Commission Appointment.
  • The appointment slots are available till 11 AM and then the open day starts. But it is better to book an appointment than waiting for open day. 
  • While scheduling the appointment, you can give the no of applicants as 1 and enter your details alone or you can enter the no of applicants as 3 and your can give your witnesses detail as well. It does not matter. All you need is an appointment and you can take an many people you want inside the the Embassy. 
Documents for Primary Applicant
  • Appointment letter.
  • Duly filled Miscellaneous application form for Consular Services. You can download the same here.
  • Original and 1 photocopy of the Power of Attorney document. A photo should be affixed in the first page and your UK address should be there in the content, mostly in the first paragraph. You should sign only in front of the Consular Officer.
  • Current passport and a self attested photocopy of first and last page.
  • BRP card and a self attested photocopy of the same.
  • Current address proof and self attested photocopy of it.
Documents for Witnesses

  • Current passport and a self attested photocopy of first and last page.
  • BRP card and a self attested photocopy of the same.
  • Current address proof and self attested photocopy of it. It is not mandatory but sometimes the officer would ask for it. The officer asked my witnesses how long they have been staying here. When they said it is more than a year she said address proofs are not required for them.
  • You can also provide notarised copies of the all the above documents but it should be notarized by a solicitor who also practices as a notary public, not from a doctor or a librarian. The officer had rejected an application because the witness documents were notarised by a doctor.

Action Day:

They will let you in even if you go 30 minutes earlier so I would suggest to go there as early as possible. In the entrance, you have to hand over the appointment letter.

The officer will call your name (yes, no digital display) so you have to pay close attention.

The officer will ask for all the documents mentioned above and he will ask you to sign in the first page and in the last page of your PoA document. Then he will ask your witnesses to sign with their address details in-front of him.

You have to pay £19 in cash or crossed postal order drawn in favour of 'High Commission of India, London'. No card payments are accepted so just go with £19 cash.

If you have all the documents ready then it would not take more than 15 minutes to do all the signings. Then the officer will give you a receipt and will ask you to come back in the evening (4.30 PM) to collect the document. You have to produce the receipt to get your document.

The High Commission seal will be stamped in all the pages and the High Commissioner or Asst. High Commissioner would have signed it in the last page.

Attestation from a Notary Public

If you decide to go to a Notary Public then search in google for your nearest notary public. You may have to book an appointment with him and normally for a 15 minute appointment, it would cast around £80 (it may vary for each notary public). 

Notary public would normally inform you all the documents you need to produce but they are almost same as the above. 

You can also get an apostille certificate from the notary public which would cost another £50. Though India is a member of the Hague Convention, it doesn't seem like our Government officers know about this. Check with your bank or Sub-Registrar office whether you need an apostille certificate.

Registering PoA in India

Once you get the attestation, you have to register your PoA in the Sub-Registrar office in your area in India. 

You should only courier or post the document from UK to India to the person to whom you are giving the power. And the envelope should be opened only in front of the Sub Registrar. Do not hand over to a friend who is travelling to India. Most of the rejection happens because of this.

If everything goes fine and if the Sub Registrar is happy with your document then he will sign and give to your attorney.

  4. Thanks Bhaskar. We have our appointment next week and I have one question which you may be able to help with. The high commission website says that we should have our photo on the last page on POA. The format that we have received from India will result in our photo going on the second last page. Last page is for my father to add his photo and for his witnesses. Do you think this will work?

    I called IHC today and they advised not to fix the photo and carry it with us. If we do this, thn the photocopy won't have our photo and this may again create issues. What should we do?

    I think it is better to take the photo to the IHC and paste it in front of them. You can take a photocopy inside IHC for 20p each.

      Thanks. It is easier if you take the witnesses with you. Otherwise, you have to get a notary public for your witnesses signature and I am not sure what kind of documents IHC would expect in this scenario. So, I would suggest you to take your witnesses with you.

We need to register the property but my wife will not be able to travel. So she will give me power of attorney. If i want to do so, do I still need to bring two witnesses? Any idea

      Witnesses should be present physically otherwise you have to get them singed before a notary public and get the document attested by the notary public. As per my understanding, this process is cumbersome and I would advice you to take the witnesses to the IHC.

    You do not need public notary signature. It was either public notary or attestation from Indian Embassy. If you are going to Indian Embassy then no need for the public notary signature.

    I have a basic query when the PoA will be sent by my attorney from India, should it already be signed by Attorney and then i take it to embassy and i will sign in front of them, or should attorney sign be blank, firstly i will sign infront of embassy person send it to india and Attorney will sign there in front of Indian Notary..

    is it important to courier the document back and open it in-front of sub registrar. In my case my wife will give me POA for a property we jointly own in India and I would travel to India. Should I still post it rather than taking it with me.

      If you are going directly then I think you can take it with you. But, I think it is better to check with your sub-registrar office before you do that. And also I am not sure whether you have to get attestation from IHC if you are going there directly. You can give PoA directly in India itself but I am not sure.

    Can the witnesses be the grandchildren(25, and 28 yrs of age).
    The son in law is an Indian National who wants the father in law's property inherited by the mother in law (uk citIzen) when she became a widow.
    PoA will be in the name of the son-in - law
    So in this situation can the grandchildren be witnesses who are both Uk citizens.

    Can anyone please provide the link for appointment booking for attestation of power of attorney documents as the above link in the forum does not work. Also does the poa document need to be attested by any indian authority in india before getting notarised at indian high comission in uk?       I heard from one of my friend that the system is down and it will not be fixed immediately. He called the VFS UK and they asked him to come to the High Commission before 12.30 PM any day. Regarding the attestation from India, you do not need any attestation from India.

    Just wanted to share how I managed the witness situation. I have had to get the POA done for me and my spouse separately. So I and my spouse signed as one of the witnesses on each other's POA. We were accompanied by one of our friends, who signed as second witness for both of us. The fee is £19 per registration.

    Thank you for a very informative article. I have two questions, if you could clarify.
    1) I need to make a POA on behalf of myself and my wife for the property rentals, sale purchase and joint bank account, to our another relative in India. Will it be possible to do it in single POA or we need to make two separate POAs?

    2) We have the content for POA but do not have the Stamp Paper here in London. Is there a way to pay stamp duty fees online or at the High Commission office? Or getting from India is the only option?

      As per my understanding, it is not required if you get the PoA signed at the Indian High Commission. if you are getting the PoA done with the Notary then you may need it.

      I don't think you can get PoA from a VFS office. VFS is a private company so you should go to HCI to get the PoA. Please note that this is just my understanding and if you want to be sure, you can quickly call VFS and check with them.

    Can the owner of property (husband and wife ) be also witness, we did this 10 years ago and was acceptable then. Please advise ?

  75. hi Baskar. I am throughly confused. My wife needs to take possession of an apartment in India and for that wanted to create a POA in the mother's name.
    This is only for executing a lease deed with the authority to take possession and not for sale.
    The notary here in UK said just a notarized POA should suffice. The agent in India says it should be from the embassy.
    Also to my previous question, does it then need registration in India because its not meant for sale/purchase.

      As per my understanding, your wife has to give PoA to her mother to execute the deed. Based on my experiences, notarized PoA is not being accepted in India so you should get it from High Commission.

    We are in the process of registering a flat in India for which my wife and I are joint owners.

    I am unable to travel to India for the registration and hence was asked to give power of attorney to my wife to be present to complete the registration process

    My wife and I are both British passport holders and have OCI cards. Specific to our case, what would be your advice around getting the power of attorney?

    I believe only Indian Citizens staying abroad can go to the Indian High Commission? Is my understanding right?

      As per my understanding, yes but some sub-registrar office may accept notarised POA but everyone will accept the POA authorised by the High Commission.

    1. Hi Jaswant, Due to covid 19, now a days they are giving appointment only for essential services like for Issue of Fresh or Renewal of Indian passport, OCI & PCC only. But for POA, you can send an email to them, if there os some emergency. Thx

    I have got an appointment on 28/8/20 @Birmingham to get power of attorney attested for bank purpose.I was asked to bring miscellaneous form,2 photos,passport,bro and current address proof.But, advocate in the bank asked me to paste my father's photo as well in the power of attorney and sign over it by me,which consulate have not asked me to do.Witnesses will accompany me to consulate.My doubt is where to paste my father's photo,whom I authorize to act in behalf of me.Can someone help me out? Also,my father has sent me blank stamp paper since all internet cafe was in locked down.Hence need to print the content in the stamp paper from UK.Is that ok?Plz do help ASAP

When I did my POA about 4 yrs ago, I was able to request others from the crowd there but wondering if it will be difficult to find a witness at embassy with lockdown restrictions in place.

    I require my PAO attested ideally by HCI but there are no appointment dates available even as far as October 2020.Can the POA be apostilled in UK and used in India because India is part of the Hague Convention,I have also been informed that POA can be notarized and attested by FCO(foreign commonwealth office)

I had to do another PoA 4-5 yrs ago when I was able to swap witnessing with another applicant there and I was wondering with covid restrictions things might be different this time. Appreciate your input. Good to know photocopying is free if needed. Should I still carry few 20p coins ?I live cashless life these days so was planning to ask for 20p coins at supermarket on my next trip.

    1. I booked from HCI website in October and got appointment easily ( I remember somehow I had ended up on VFS website where they show POA appointment process which doesnt work). My appointment was on 4th Nov and although I did take two witnesses with me but there were a good number of applicants and witnesses inside and I am very sure it wouldn't have been difficult to get help from two of the crowd there. I do not know if they will change any rules regarding number of people inside during the one month lockdown. My appointment was at 11.40 , I reached early and was served on arrival even if it was before time. Its as per availability of the staff.

    2. Also just to add, the stamped documents were returned same time within 20 minutes and I did not need to go back to collect later in evening or such . I think on that day at least, everyone there was being asked to wait for the stamped documents and wait was about 15 min.

    I am also trying to book an online appt, it s not possible at all. Phoned HCI, they said, appts open at Indian midnight time. As soon as they open, people are waiting and slots get filled quickly. Once the slots are full, we can't book anymore and we need to keep trying.
